Loakia respects the intellectual property rights of others and expects the same from its users. This policy explains our approach to copyright, trademark, and other intellectual property claims, and provides instructions for submitting notices of alleged infringement and counter-notices.

1. Ownership of Content

All content on the Loakia website, including but not limited to text, images, logos, product photos, designs, videos, site layout, and code, is the property of Loakia or used by Loakia with permission. All rights are reserved unless expressly stated otherwise.

Customers and visitors may not copy, reproduce, distribute, modify, display, perform, or create derivative works of any content from our site without prior written permission from Loakia or the relevant rights holder.

2. Trademarks

“Loakia” and any logos, product names, and taglines displayed on this site are trademarks or service marks of Loakia. Use of Loakia trademarks without our prior written permission is strictly prohibited.

3. User-Submitted Content

If you submit content to Loakia (for example product reviews, images, or other materials), you represent and warrant that you have all rights necessary to submit the content and grant Loakia a worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content on our site and in marketing materials.

4. How to Report Alleged Infringement

If you believe that your intellectual property rights have been infringed by content on our site, please provide a written notice containing the following information:

  1. A physical or electronic signature of the person authorized to act on behalf of the owner of the intellectual property right.
  2. Identification of the copyrighted work or trademark claimed to have been infringed (including registration details if available).
  3. Identification of the infringing material on our site, with sufficient information to locate it (URL(s), product SKU, description, etc.).
  4. A statement by the complaining party that, in good faith, the use of the material is not authorized by the rights owner, its agent, or the law.
  5. A statement that the information in the notice is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the rights owner.
  6. Contact information for the complaining party, including name, mailing address, telephone number, and email address.

5. DMCA Procedure (for Copyright Owners in the United States)

If you are a copyright owner or an agent thereof and believe that content hosted on our site infringes your copyright, you may submit a DMCA takedown notice containing the elements described in Section 4 above. Upon receipt of a valid DMCA notice, Loakia will:

  • Promptly remove or disable access to the allegedly infringing material; and
  • Make reasonable efforts to notify the user who posted the content that we have removed or disabled access to the content.

6. Counter-Notification Procedure

If you believe that material removed or disabled as a result of a notice of infringement was removed in error, you may submit a counter-notification. The counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, telephone number, and a statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, a statement that you will accept service of process from the person who provided the original DMCA notice).
  5. Your signature (physical or electronic).

Send counter-notices to the same contact details listed above. After receiving a valid counter-notice, Loakia may reinstate the material unless the original claimant files a court action seeking a restraining order or injunction within the time permitted under the DMCA.

7. Repeat Infringers

Loakia reserves the right to terminate, suspend, or restrict access to users who are repeat infringers in appropriate circumstances.

This policy is for notice and procedural purposes only and does not constitute legal advice. Loakia makes no representation concerning the outcome of any infringement claim. We may update this policy from time to time; changes will be reflected by the “Last Updated” date above.
